Campaign Event Terms & Conditions

Welcome to First Plunge - a Pony Rider community campaign inviting people to reconnect with water, from peak to sea, in support of the Australian Marine Conservation Society (AMCS). Before you register, take part in the Challenge, or join us at Avalon, please take a moment to read these Terms and Conditions. They set out your rights and responsibilities as a participant, and what you can expect from us. By registering for First Plunge, creating a fundraising page, logging a Challenge activity, or attending the Event at Avalon, you agree to be legally bound by these Terms and Conditions. 1. Who we are and what First Plunge is First Plunge (the “Campaign”) is hosted and managed by PR Studio Pty Ltd trading as Pony Rider (ABN 16 606 234 628) of Unit 3, 10 Tengah Crescent, Mona Vale NSW 2103, referred to in these Terms as “Pony Rider”, “we”, “us” and “our”. First Plunge is a Pony Rider community fundraising campaign, delivered under the Wild Meets program, raising funds for the Australian Marine Conservation Society (AMCS). First Plunge is made up of: the Challenge — a self-directed, 30-day swim or plunge challenge that participants undertake at a location of their own choosing; and the Event — a community gathering at Avalon Surf Life Saving Club on Sunday 30 August 2026, 8:00am–11:30am, which marks the start of the Challenge period. Campaign dates, the Challenge period and the Event details are as published on the First Plunge fundraising page from time to time. We may update these dates or details, and will communicate any material changes through email, social media or the fundraising page. 2. Definitions ‘Campaign’ means First Plunge 2026 in its entirety, including the Challenge and the Event. ‘Challenge’ means the self-directed 30-day swim or plunge activity that participants log on their personal Raisely page at a location, time and manner of their own choosing. ‘Event’ means the in-person gathering at Avalon Surf Life Saving Club on Sunday 30 August 2026. ‘AMCS’ means the Australian Marine Conservation Society, the nominated fundraising beneficiary of the Campaign. ‘Raisely’ means Raisely, the independent third-party fundraising platform used to register participants and process donations, hosted at first-plunge-30-day-swim-challenge.raiselysite.com, and operating under its own terms of service available at raisely.com/terms. ‘Participant’, ‘you’ and ‘your’ refer to any person who registers for, fundraises for, takes part in, or attends any part of the Campaign. ‘Personal Information’ has the meaning given in the Privacy Act 1988 (Cth). 3. Registration and participation Registration for the Challenge and the Event is via the First Plunge Raisely page and is free. Fundraising is optional. You must provide accurate and current information when registering, including your name and contact details. First Plunge is open to participants of all ages. Participants under 18 must take part with the supervision and consent of a parent or guardian, who by allowing the minor to participate agrees to these Terms on the minor’s behalf and takes responsibility for the minor’s safety and supervision throughout the Challenge and the Event. We may refuse registration, or remove a participant’s access to the Campaign, at our discretion, including where a participant’s conduct is unsafe, offensive, threatening or otherwise inappropriate. 4. Assumption of risk — the Challenge The Challenge is self-directed. You choose your own location, water conditions, timing and manner of participation, and Pony Rider has no ability to supervise, assess or control any of these choices. You participate in the Challenge entirely at your own risk. Pony Rider does not provide lifeguards, water-safety supervision, or on-site support for Challenge swims or plunges undertaken away from the Avalon Event. You are responsible for choosing a location and conditions appropriate to your own ability and health, checking local conditions, tides, currents, weather and safety signage or flags before entering the water, and never swimming alone in unsafe conditions. If you have any pre-existing medical condition that may be affected by cold-water immersion or swimming, you should seek medical advice before taking part. Pony Rider is not responsible for, and accepts no liability for, any injury, illness, loss or damage arising from your participation in the Challenge. 5. Assumption of risk — the Event at Avalon The Event at Avalon Surf Life Saving Club involves entering open water. Attendance at, and participation in, the Event — including any swim, plunge or water-based activity — is at your own risk. Pony Rider does not guarantee lifeguard or water-safety patrol coverage for the Event and does not warrant that the water or weather conditions on the day will be suitable for swimming. You should only enter the water at the Event if you consider it safe to do so given your own ability, health and the conditions on the day, and should follow any on-site instructions, signage or safety flags. If conditions are assessed as unsafe, we may modify, delay or cancel the water-based component of the Event, in which case an alternative land-based gathering may proceed. If you are unable to attend Avalon, you may complete your final Challenge plunge at a location of your own choosing, subject to the same assumption-of-risk terms as the Challenge generally. 6. Liability To the fullest extent permitted by law, Pony Rider does not accept liability of any nature for any injury, illness, death, loss, damage, delay or additional expense arising out of or in connection with your registration for, or participation in, the Challenge or the Event, including where that injury, loss or damage arises from water conditions, weather, third-party conduct, or your own act or omission. Where legislation implies a condition or warranty that cannot be excluded, that condition or warranty is included in this agreement, but our liability for breach of it is limited, to the extent permitted by law, to re-supply of the relevant registration or, where re-supply is not reasonably possible, the cost of re-supplying it. Nothing in these Terms excludes, restricts or modifies any right or remedy that cannot lawfully be excluded, restricted or modified under the Australian Consumer Law or other applicable law. 7. Our relationship with AMCS First Plunge is a Pony Rider-owned and Pony Rider-managed campaign raising funds for AMCS. It is important that participants understand the nature of this relationship: Pony Rider is an AMCS Business Supporter. This is a business-support and fundraising collaboration, not a legal partnership, joint venture, agency or affiliation between Pony Rider and AMCS. AMCS is the nominated fundraising beneficiary of the Campaign. AMCS is not the event organiser, co-host, water-safety provider, or an endorser of Pony Rider or its products. Pony Rider is solely responsible for organising, managing and delivering the Challenge and the Event. AMCS has no role in, and no responsibility or liability for, the planning, delivery, safety or conduct of the Challenge or the Event. Neither party has authority to act on behalf of, or bind, the other. Pony Rider is not an agent of AMCS, and AMCS is not an agent of Pony Rider. 8. Donations and fundraising Fundraising through your personal First Plunge page is optional and separate from registration and participation. Donations made through the Raisely fundraising page are processed via AMCS’s own Stripe account and are paid directly to AMCS. Pony Rider does not receive, hold, control or retain any percentage of donated funds. Donation receipts and payment enquiries are handled directly by AMCS. Any fundraising totals, milestones or results shared during the Campaign are preliminary and subject to confirmation by AMCS. Registration, fundraising pages and donations are hosted on Raisely (first-plunge-30-day-swim-challenge.raiselysite.com), an independent third-party platform. By registering or creating a fundraising page, you also agree to Raisely’s own terms of service, available at raisely.com/terms, which separately govern Raisely’s collection and handling of information you submit through the platform. Pony Rider is not a party to, and accepts no liability for, Raisely’s handling of your information under its own terms. 9. Merchandise and product purchases Any First Plunge merchandise (such as limited-release towels or plunge jackets) is sold separately from, and is not a condition of, fundraising or donation. Purchases are subject to availability, and Pony Rider does not guarantee stock will be available at any given time. Product purchases do not constitute a donation to AMCS unless expressly stated at the time of purchase. 10. Content, photography and consent By participating in the Challenge or attending the Event, you consent to Pony Rider photographing, filming or otherwise recording you, and to any images, video, reflections or other content you upload to your First Plunge page being used by Pony Rider for promotional, marketing and campaign-reporting purposes across First Plunge channels, in perpetuity, without further notice or compensation, unless you notify us that you withdraw this consent. Where content includes a participant story, quote or identifiable image intended for wider publication (for example, in a case study), we will seek your specific consent before publishing. 11. Code of conduct First Plunge is a community event and everyone taking part is expected to act in an orderly, safe and respectful manner toward other participants, volunteers, AMCS representatives and members of the public. We may refuse entry to, or ask to leave, any person behaving in an intoxicated, disorderly, offensive, threatening or otherwise inappropriate manner. 12. Cancellation, postponement and weather First Plunge is an outdoor, weather-dependent campaign. We reserve the right to cancel, postpone, reschedule or modify the Event or any element of the Challenge for any reason, including adverse weather, unsafe water conditions, venue availability, or circumstances beyond our reasonable control (such as natural disasters, public health orders, or government directions). Where reasonably possible, we will communicate any changes through email, social media and the fundraising page. As registration is free, no refund applies; where a paid product or ticketed component is introduced for a future First Plunge event, separate refund terms will be published for that component. 13. Intellectual property The First Plunge name, campaign line “A Collective Plunge from Peak to Sea”, logos, creative assets and campaign materials are owned by Pony Rider (or used under licence) and may not be reproduced, modified or used for commercial purposes without our prior written consent. 14. Privacy Our collection, use and disclosure of your personal information is set out in the First Plunge Privacy Policy, available on our website and referenced on the First Plunge fundraising page. Please note that donations are processed directly by AMCS through its own Stripe account, and AMCS handles donor payment information in accordance with its own privacy policy. 15. General This agreement is governed by the laws of New South Wales, Australia, and the parties submit to the exclusive jurisdiction of the courts of New South Wales. If any part of this agreement is held void or unenforceable, that part is severed and the remainder continues in full force. Pony Rider may assign, license or sub-contract its rights and obligations under this agreement without your consent. A failure by Pony Rider to enforce any right under this agreement is not a waiver of that right. 16.
