Privacy Statement

This Privacy Statement explains how PR Studio Pty Ltd trading as Pony Rider (ABN 16 606 234 628) of Unit 3, 10 Tengah Crescent, Mona Vale NSW 2103 (Pony Rider, we, us or our) collects, uses, discloses and protects personal information in connection with First Plunge 2026.

First Plunge is a Pony Rider community campaign, and Pony Rider has been appointed and authorised by the Australian Marine Conservation Society Inc (ABN 53 409 718 351) (AMCS) to raise funds through this campaign.

The campaign is a self-directed 30-day swim or plunge challenge undertaken independently by registered participants from 1 to 30 September 2026 at locations of their own choosing, and includes an optional indoor kickoff gathering at Avalon Surf Life Saving Club on Sunday 30 August 2026.

Pony Rider handles personal information in accordance with this Privacy Statement and any applicable privacy laws. Raisely, AMCS, Stripe and other service providers may also handle information under their own privacy policies and legal obligations, as explained below..

1. When we collect personal information

We may collect personal information when you:

  • register for First Plunge, the self-directed Challenge or the Avalon gathering;
  • create or manage a First Plunge fundraising page through Raisely;
  • contact Pony Rider about the campaign or request participant support;
  • upload an image, reflection, activity record or other campaign content;
  • attend the Avalon gathering or appear in campaign photography or video; or
  • purchase First Plunge merchandise through Pony Rider.

2. Information we collect and why

The information we may collect includes your name, email address, telephone number, postal address, registration choices, communication preferences (including whether you have separately and voluntarily consented to receive marketing communications from us), team or community details, fundraising page information, activity records, images, reflections, enquiries and other content you choose to provide. We do not collect any sensitive information, including health information, or any financial information.

We use this information to:

  • register you and administer your participation in First Plunge;
  • send operational messages about the campaign, the Avalon gathering and material changes;
  • provide participant and fundraising-page support;
  • moderate or publish campaign content where permitted;
  • report campaign participation and outcomes;
  • fulfil merchandise orders and respond to customer-service requests;
  • protect the safety, integrity and lawful operation of the campaign; and
  • send future Pony Rider news, offers, campaigns and marketing communications only where you have separately and voluntarily consented to receive them..

3. First Plunge and Pony Rider communications

By registering for First Plunge, you agree to receive communications from us required to administer the campaign. These may include registration confirmations, event or challenge information, safety reminders, fundraising-page support and notices about material campaign changes..

Receiving future Pony Rider news, offers, campaigns and other marketing communications is optional. You will only receive these communications if you separately and voluntarily provided your consent to receive marketing communications by selecting the marketing consent checkbox during registration or otherwise subscribe to Pony Rider marketing. You may unsubscribe at any time using the unsubscribe link in a marketing email or by contacting customerservice@ponyrider.com.au.

Unsubscribing from ongoing marketing will not prevent us from sending a message that is reasonably necessary to administer an active registration, respond to your request, or meet a legal obligation. You may contact us if you wish to withdraw from the campaign entirely.

4. AMCS and personal donation information

AMCS is the fundraising beneficiary of First Plunge. Donations made through the First Plunge fundraising page on Raisely are processed through AMCS's connected Stripe account and paid directly to AMCS. For any disputes, enquiries, or concerns regarding donations made using your credit card, please contact AMCS directly..

Pony Rider does not receive, hold or distribute donated funds and does not receive a fee, commission or percentage of donations. Pony Rider does not donate any portion of the purchase price of First Plunge merchandise to AMCS or any other charity.

AMCS may access and use donor or participant information only where reasonably necessary to administer donations, issue receipts, process refunds or chargebacks, respond to donation-related enquiries, meet its legal and financial-record obligations, and report confirmed fundraising outcomes. AMCS handles the information it receives in accordance with its own privacy policy

Pony Rider does not share any personal information relating to participants with AMCS for any purpose other than those described above, including for marketing purposes.

5. Raisely, Stripe and campaign-page control

First Plunge fundraising pages are created on Raisely by registered participants. Pony Rider may also create First Plunge fundraising pages.

During the fundraising period, AMCS’s Stripe account will be connected to those fundraising pages on Raisely to process voluntary donations. Authorised Pony Rider staff will manage participant communications, campaign content and the campaign domain.

Information submitted through Raisely may be processed by Raisely and may be accessible to authorised Pony Rider and AMCS personnel according to their campaign roles and access permissions

A Card and payment details are processed through AMCS's Stripe account; Pony Rider does not receive or store full payment-card details.

At the end of the campaign, Pony Rider may retain participant registration and campaign records for the purposes described in this Privacy Statement. AMCS may retain donation, receipt, refund, chargeback and financial records in accordance with its own privacy policy and for purposes such as complying with its legal, accounting and charitable obligations. Your use of Raisely and Stripe is governed by their respective privacy policies and terms. We encourage you to review the notices presented on the relevant registration or payment page and to visit the respective organisations’ websites to read and understand their privacy practices.

6. When information may be disclosed

Pony Rider may disclose personal information to service providers and advisers that reasonably need it to help deliver or protect First Plunge, including AMCS, Raisely, communications providers, website and technology providers, event suppliers and professional advisers.

We may also disclose information where required or authorised by law, or where reasonably necessary to protect a person, our rights or the integrity of the campaign. We do not sell participant information.

7. Security and retention

Pony Rider takes reasonable steps to protect personal information from misuse, interference, loss and unauthorised access, modification or disclosure. Access is limited to people and providers who reasonably require it for their role.

We retain information only for as long as reasonably necessary for the purposes described in this Privacy Statement, including campaign administration, reporting, marketing where consent remains current, dispute management and legal or record-keeping obligations. We will take reasonable steps to delete, destroy or de-identify information when it is no longer required, subject to lawful retention requirements and technical limitations. .

8. Access, correction, withdrawal and complaints

You may ask to access or correct personal information held by Pony Rider, withdraw from Pony Rider marketing, or make a privacy complaint by contacting customerservice@ponyrider.com.au. We may need to verify your identity before actioning an access or correction request.

For information held by AMCS, Raisely or Stripe in their own capacity, you may also need to contact that organisation directly. If you are not satisfied with Pony Rider's response to a privacy complaint, you may contact the Office of the Australian Information Commissioner at www.oaic.gov.au or on 1300 363 992.

9. Third-party services and links

The Pony Rider website and First Plunge pages may link to or use third-party services, including Raisely, Stripe and AMCS websites. Those services may have their own terms and privacy practices.

Pony Rider does not control or influence how an independent third party collects, uses, stores, or discloses information in its own capacity and makes no warranties or representations regarding that third party’s privacy practices. .

We will notify you by email of any amendments to this Privacy Statement before they take effect. Your continued registration, participation in, or access to the First Plunge campaign following those amendments constitutes your acceptance of the amended Privacy Statement. The current version will be published with its effective date. .

Pony Rider owns and manages the First Plunge campaign. AMCS collaborates on approved conservation and fundraising content and connects its Stripe account within Raisely, so donations are paid directly to AMCS. Pony Rider does not receive or hold public donations. Participation is free and fundraising is optional.
